wrongful termination during fmla

i am off on fmla for back surgery, my employer has already replaced me and advised me to look for another job as he does not have a position available for me when i am released. can he do this? need advise how to persue this?

You asked about FMLA leave.

FMLA is pretty clear that a position must be held for a person where the claim falls within FMLA parameters.

You need to speak with an attorney immediately to both mitigate damages and to secure your rights.
