Legal Question in Civil Litigation in Pennsylvania

Adr

Are arbitrations allowed through a voluntary process through contract agreements? If a case is arbitrated through a voluntary process, do the arbiotrators have the power to issue subpoenas? Cant he court require that some actions must go through to arbitration process?

Re: Adr

You asked about arbitration.

Often arbitration is mandatory when contracted beforehand. Arbitrators do not have the power to issue subpoenas, but courts can often be enlisted to do so in arbitration matters. Arbitration is often a bad choice for consumers against businesses but is a good option for businesses against businesses.

You must have an attorney for arbitration. Arbitrators have more authority than judges (and absolutely no oversight) and often arbitration is relatively final. There are very few causes for appeal in arbitrations.

Roger
