Legal Question in Civil Litigation in Pennsylvania

Automobile Lease Contract

My fiancee signed as a primary borrower on a car with his friend as a co-signer (his credit was not good enough to be primary). He was helping out his friend who was in a bind and had to have a car.

We have had to contact his friend on several occassions asking why he is having problems paying on time. We have offered options to help him and he refused.

We have just been advised by the financing company that they have reported negative activity to my fiancee's credit report. My fiancee owns his own business and this negative report can affect him in regards to needing money for his business.

My fiancee is trying to find out his rights. Can he pay off the loan and take possession of the car?

We repeatedly explained to the ''friend'' the importance of paying. He obviously does not care.

Any advisement is appreciated.

Please advise.

Re: Automobile Lease Contract

Unfortunately, ig the loan the car is paid off the owenership will belong to the person in title. I assume it in only in the name of the friend. Your friend would have to pay your fiancee back. If your friend will not cooperate, the your financee's credit will be ruined. I suggest you consult legal counsel for more details. Gerald Hershenson Esq. 215-579-9390
