Legal Question in Civil Litigation in Pennsylvania

We are a business and have a civil suit pending against us by another business. It had been brought against us by the owner of the business who is now serving a 3 yr sentence in a federal penitentiary. It is currently in appeals. In the meantime his business has filed another suit against us for the same matter. Is this legal? What do we do from here?

It's not illegal. It is just not allowed. What you need to do is raise Preliminary Objection to the new suit, assuming the suit was filed in Common Pleas Court. If it was filed at the DJ you would have to file a notice to defend and then raise the issue at trial.
