Legal Question in Civil Litigation in Pennsylvania
I took my car to an auto shop to get it fixed, it was fixed and fully paid off but the autobody shop would not return my vehicle. He's been holding it for almost 3 years now. Even though i filed a claim 3 times (upon his appeals to decrees in my favor) he is still not returning it. On top of it he filed a petition for the title to vehicle which was denied. That case still seems to be active. What do I do now? What is my next step?

What you really have to do is file a Writ for possession of the vehicle, in which the Sheriff will go out and actually seize the vehicle. As I don't know the contents of the legal papers filed i can't be anymore specific. I really think you should consult with an attorney, and bring all your papers. The solution might be very easy or more difficult, depending on the papers. If the final Order in the case granted you possession of the vehicle, it is simply a matter of going to the Sheriff. If not, you would have to file a separate Petition for possession with the Court and then go to the Sheriff. It is a complicated area of the law, and that is why I suggest you meet with a lawyer.
