Legal Question in Civil Litigation in Pennsylvania

cemetery plot ownership & rights

in 1981 my 11 year old daughter died in an accident. My ex-husband and I were not financialy stable and no insurance to cover cost.

My ex had not worked steadily and was self employed at the time. Hardly making any money. I have always worked to try to support my family. Many people and relative had given us money to help us through this hard time.

We used some of that money to purchase four cemetery plots, in asmall local cemetery. My ex went to purchase them, I now find out that these we put in his name only.

He collects VA disability , because he considered, to have a mental condition and is certified with the papers to prove it for the past ten years or so.

He was told that he now been told that he has cancer and has 3 mo to a year to live.

He state that he has given the deed to the cemetery to a church for them to use for whatever they want. My 3 daughters are very upset and feel that he has given my deceased daughter away.

Is there anything that I can do to stop this from happening.

We just don't understand why someone would just give this away, when we still have many family member left, God forbid we would need them, I also have a grandson in Iraq, which leaves many possibilies there thank you

Re: cemetery plot ownership & rights

Unfortunately, you have no right to the plots. However, I suggest you speak with the church pastor or other representatives about your concerns. They may help you. Your children could possibly inherit the plots upon your ex husband's death. However, I suggest you speak with legal counsel. Gerald Hershenson Esq.
