Legal Question in Civil Litigation in Pennsylvania

civil suit for property that's not mine

I am 7 months pregnant, and my adoptive mother recently gave me some baby gifts. She found out that my fiance's family was also having a baby shower for me, she got really angry and is now demanding the gifts back. I refused, and now she is suing my fiance (I am not named in the suit) for the gifts. How can she do that? He was never present when she gave me the gifts, and they're not his to give back. What can I do?

Re: civil suit for property that's not mine

You asked about a really petty action by your mom.

There's more going on here than you let on in your query. But no, your mom cannot redeem gifts through court. Gifts are gifts and the court will throw the case out as long as you as the defendant appears to present a defense.

There's probably a family issue that is going on and your family (all of them) needs a type of counseling that lawyers do not provide.

Regards,

Roger
