i got a court subpoena

hi my question my girlfriend and i were sitting in traffic and an accident happened she saw it i didnt but all i could find was one of my buisness cards to give the person in the accidentwith my phone number so they could get in contact with my girl friend.a letter from the persons insurance company came addressed to me for her statement on the accident she had me signe it because it was in my name and i didnt think it would be a problem but now i got subpoenad to testify in a lawsuite and i tryed to get in contact with the lawyer but he wont return my calls i dont know what to do because i didnt see the accident and im not going to miss work to go to court what should i do.

If you did not receive payment for a witness fee, usually about $25, the subpoena is not valid. Also, most attorneys will agree to pay you for any lost wages, parking fees or other fees. Most attorneys wil not speak to a witness before the deposition. I suggest you contact the attorney's secretary or legal assistant & discuss these issues, including your lack of knowledge about the accident. In the end, if you receive a valid subpoena, you will need to appear.

If you're subpoenaed you have to go, or you'll be arrested. That's probably worse than missing work.

Write or call the lawyer and tell him you didn't see anything and ask to be released from the subpoena.
