Delay of settlement

Is it lawful to not pay a settlement

after you sign it until five months later

as the state is on a budget

I would need some more information. In some situations, there are motions and legal papers you can file to enforce a settlement. Usually, settlements are governed by law and the type of settlement could make a difference as well.
