Falsely accused of harrasment

I was accused of harassment by a fellow employee but was exonerated of all charges. What are my rights since I was falsely accused by this person? I also lost a promotion because the accusations were made during the application process & the promotion was given to someone else.

You asked about your rights after being exonerated re charges of harassment.

There are any number of rights that you can assert. But the question is are they enforceable and is it worthwhile to pursue them.

The company has many avenues of potential liability. But a company does not have to keep an employee that is suing it unless that suit were for unlawful discrimination. And the employer would have had more trouble had they not taken the allegations seriously. You might also point out to the company that false allegations should be acted on.

You have better chance of pursuing the person(s) who made the allegation. The defamed you by falsely alleging you were harassed them. And the damage to you may be exactly as you state. So what exactly is the likelihood that the person could compensate you for that damage?

I agree with the previous response. If you decide to pursue an action there are statute of limitations. The statute for defamation is much shorter then other personal injury action. You must pursue an action within one year of the defamatory incident. You should contact an attorney if you are in the stautory period.
