Legal Question in Civil Litigation in Pennsylvania
Hello:
My attorney and I have mutually split ways. He has officially withdrawn his appearance from my case. My question is, can I request and is he required to hand over my file so that I can give it to my new attorney? Any advice is much appreciated.

You can request it, and as long as you and the attorney are financially settled, he will turn your complete file over to you. If you still owe the attorney money, however, he retains an "attorney's lien" on the file -- just like an auto body shop would have a lien on your vehicle until you pay. Once you pay the mechanic, you get your car; once you pay your attorney, you get your file. Hope this helps.
