Legal Question in Civil Litigation in Pennsylvania

My husband and I went to dinner at a popular restaurant chain. We ate our meal and when the included ice cream sundae came I began eating mine and found a small wad of what looked like lint in the ice cream. It was really disgusting. I told the waitress and she informed her manager. They both apologized and took 50% off the bill. It really was very disturbing. I will never eat at that restaurant again and probably never at one of those restaurants again. I'm not even sure I will be able to eat out again without thinking about it.

Should I let it go or is there legal action that should be taken against the restaurant chain?

I know it is disgusting to find something in your food that you did not expect. I have found bugs in my salad several times. I still eat out.

Unless you got very ill and had to seek medical treatment, let it go at what the restaurant did. I am sure they were not happy about it either. It may not even have been their fault! If this was ice cream, it was probably supplied by someone else - it could have fallen in at the manufacturing plant. I don't know, but it is possible unless this place makes their own.

Llitigation is very time consuming. It also is very costly and generally you do not recover attorney fees unless there is a particular rule or statute that allows it.

If it were me, I would just let it go and move on.
