Identity Theft

I have had my identity stolen for the 2nd time. Fraud alerts have been on all my credit reports since 2003. In this case the thief used my SSN & her name & address to join a fitness center. The fitness center requires an SSN but they do not check credit. If the thief is arrested can I sue the fitness center? They asked for personal information but did not verify that it was correct.

You can sue anybody for anything. The question is whether or not you can win and what you can win. In this case, it doesn't appear clear to me that you have lost any money. If the fitness center was paid from your funds and you are out of pocket and the person is arrested and prosecuted, then you will probably be entitled to recover restitution through the criminal proceeding.
