Legal Question in Civil Litigation in Pennsylvania

Landlord/ Tenant Law-Laws of Civil Proceadure????

I won my case against my landlord for return of my security deposit. Her attorney then appealed the decision in the Court of Common Pleas. I have, so far, answer her claim, made a counterclaim and then opposing counsel offered to discontinue with predjudice. I have denied the discontinuance. Now what do I do so I can get this case overwith?

I know I can win, but what is the next step in civil proceadure

If you are in Common Pleas Court, you are over your head. Get a lawyer. If you are foolish enogh to try to represent yourself, you should now engage in appropriate discovery proceedings, followed by any appropriate pretrial motions, then place the case on the trial list.

Re: Landlord/ Tenant Law-Laws of Civil Proceadure????

Dear Sir or Madam:

If you have already filed an anser to the landlord's complaint the next step in a civil action such as this would be for the discovery process to begin. At this point both sides may request the other side to produce ceratin documents. They may also ask the side to answer certain questions concerning the case. Also deposition, which are pretrial testimony questions and answers may be set up. At this point in the proceedings you are about to enter a legal area which will require some legal knowlegde. Since the other side has retained counsel you may wish to do so yourself or suffer the effects of being at a disadvantage for the remainder of the case.

I practice in the Greater Pittsburgh area and practice in the litigation area. If I can be of assistance please contact me.
