lost or stolen property at a public resturant
A customer leaves a $400 cell phone at a public resturant. Upon his return to retrieve the cell phone the manager informs him that she took possession/retrieved the phone gave it to an employee that placed it in a box and then another employee took it and gave the phone to another customer(not the proper owner). The restraunt has no policies or security proceedures concerning securing customers property and has a sign posted ''not responsible for lost items''. Because the restraunt took posession of the phone... are they quilty of negligance and/or liable for the replacement costs to the rightful customer/owner
