Legal Question in Civil Litigation in Pennsylvania

Misrepresentation by private seller

Just bought a 90 Chevy van for $2,500. Seller was asked on 2 different occasions if there were any problems. Answered 'no'. Seller drove the vehicle to the location of the tag service. We brought the vehicle home. Started it a couple hours later and noticed a lot of smoke coming from the exhaust. Called the seller to see if he would help in repairs and he gave the answer 'buyer beware' in a smart tone. Now we've put about $700 in repairs into the engine. Do we have any legal rights to sue for the repairs?

Re: Misrepresentation by private seller

You asked about car repairs for a newly purchased auto.

Generally the little jerk is correct. A purchaser is supposed to inspect a vehicle before purchase. Purchase from an individual is generally a final sale with no recourse.

In this you have a minor chance of recovery of the repair expenses. You definitely should sue the jerk seeking recovery of your repair expenses. My guess is that he'll hang himself in front of the judge.

Good luck.

Roger
