Legal Question in Civil Litigation in Pennsylvania

Mother Breaches Promise

My mother had lost her property for failure to pay the property taxes. I hired and paid an attorney we did get the property back. My mother asked the attorney to draw up papers to place my name on the property in exchange for paying the legal fees.

Once papers were drawn up, mother refused to sign them and has now put the property in my brother's name.

Do I have any legal standing here, at least to get my money back? I feel very embarrassed over this, this is my own mother! I'm not trying to be mean and spiteful, I just feel the situation is very unfair.

Re: Mother Breaches Promise

You asked about breach of promise.

Actually what you have is a very standard claim of breach of promise. You need to speak with another attorney about this matter. The new attorney may be able to either seek to have you compensated or even obtain the house.

You are correct that the situation seems unfair but it is very common for this to happen.

Contact a local attorney immediately. The prior attorney will be a witness so ethical considerations prevent him/her from representing either either side.

Regards,

Roger
