Legal Question in Civil Litigation in Pennsylvania

If a neighbor is creating and responsible for a bird nuisance do I have any legal recourse? He has refused to anything. IT is causing damage to my home, let alone the frustration I feel about the dropping, the bird mites, the noise. Pest Control has advised that if the neighbor takes no steps to remove the cause there is really nothing they can do.

You can file a nuisance action. If successful the court will order the neighbor to remove the condition, & may award you damages. The mere filing, or threatening to file by a lawyer, may motivate the neighbor to stop. You will need an attorney since this is not filed in small claims court, but would be in our regular trial court, known as common pleas court. I suggest you take many appropriate photos & video, showing the dates & times, so you'll be able to show the judge (& your lawyer) the nuisance.
