Legal Question in Civil Litigation in Pennsylvania

My niece has to walk 0.3 miles (per the school) to her bus stop from her new address. In order to get there, she must cross the road from her driveway to walk against oncoming traffic. As there are NO SIDEWALKs, this kindergartner would have to walk on the road or in the roadside ditch to get to her bus stop. The school is saying they will not change the bus stop, although kids who have lived there previously had been picked up at the driveway. We are concerned for her safety. Do we have a legal right to fight this?

I don't know that there is a means to FORCE the school, but keep track of any communications you have with the school (e-mail is good for this). That way, if anything happens--even a scare, the school will be hard-pressed to say they didn't have notice.
