Legal Question in Civil Litigation in Pennsylvania

Last night at !!pm my husband was going out. He stepped off sidewalk onto street broke his ankle . The asphalt uneven . Could my husband get pain and suffering from borough. They were contacted by my landlord and they came to check road at 10pm. Told me if they have extra asphalt from patching next street they will fix it. He has to go Specialist

for a permanent cast. Are they liable for his injury?
