Legal Question in Civil Litigation in Pennsylvania
Obtaining Lost Money
I purchased a quad off of a man I work with, I paid him $900 cash, and never recieved a receipt. One week ago he picked up the quad saying that he was going to get it repaired. He then sold the quad behind my back and refuses to give me my $900 back. I have many witnesses which have directly been told that he sold me the quad, as well as several who he told that he was going to sell it behind my back and not give me my money back. I also have many witnesses who have seen the quad in my possession. How do I go about getting my money back from this man who refuses to return it to me? What is everything I need to strength my case in the absence of a receipt?

Re: Obtaining Lost Money
If you had a contract with this person, even if it is oral, you should file a claim in small claims court. If he is a resident of the same state, he will be served with process, and you will eventually have a day in court where you can present all of these witnesses. I would send him a final demand letter and warn that you will be filing a lawsuit in court. He should probably settle either before or after you file. Also, if he stole the quad, did you not file a police report?
