At a gasoline convience store a large square white sign next to the road indicated in large black bold letters what they had available. The wording was amuzing and thought it was worthy to capture a photo and submit it to a paper. The particular paper offered $50 if used. If this store would see this picture in a publication could they sue for my not asking first if I could take a picture of the sign.

Although I am not an expert on copyright law, I do not believe that you could be sued for taking a photograph of a sign that is outside, and displayed to the public. The fact that a newspaper is willing to pay you 50 dollars for the picture should not make a difference. It might be different if the picture was of a person, but it is not. I see no problem here.

YOu should not have aproblem but to be safe, get the newpaper to give you an indemnification in the eveent you are sued. I dont believe there is a claim against you especially if the owner is not identified
