At best he's entitled to the value of the ATV at the time you used it. He's only entitled to that if he can prove that the ATV was totaled. Otherwise he can recover the cost of repairs up to the value of the ATV.

If you have homeowners or renters insurance they might have to defend you as it would fall under your liability coverage.
