Legal Question in Civil Litigation in Pennsylvania
Hello, I recently applied for, and was given a job at a local university, contingent on my background check. When the background check was run on me, it showed a felony conviction in 1996, which was never a conviction, as I completed the ARD program and had it exponged. I tried to get this resolved with the background check company. I had got certified paperwork from the courthouse, district attorny, and the state police, stating that I have no convictions. The background company refuses to remove this from there report, and I lost the job. The university explained that I had the felony when I filled out there paperwork, and therefore consider me a liar. Is there any legal action I can take, and if so what will I get out of it, as the job will most likely be gone in the interem.

If in fact the information obtained by the background check company was false or incomplete, you could have a case against them. Depending on the circumstances, you may also have a case against the university. What you would get out of it would likely be something based upon the wages you lost as a result of not getting the job.
