Legal Question in Civil Litigation in Pennsylvania

recieved a bad check

back in april i was given a personal check ($300.00) for the purchase of a vehicle the check was returned a month later NSF. i filed a bad check complaint and a trial date was set. The individual who gave me the check did not appear for court. I was told a warrant would be issued for him and i would be updated on the progress of the case. I sent a letter to the justice office last month (sept) and have heard nothing back from them. It has now been 5 months since i was given the check is there any way that i can collect my money on it, such as a wage garnish or tax return garnish? Any help or advice in this area would be greatly appreciated.

Re: recieved a bad check

Before pressing charges against an individual for passing a bad check, you are required to give that person ten days notice to honor the check. Only then can criminal charges hold up. I do not know the reason for the delay but you can not garnish wages or taxes. However, you will have to file a civil complaint to force collection after you obtain a judgment. You may attached bank accounts, levy on personal property etc. Gerald Hershenson 215-579-9390
