Legal Question in Civil Litigation in Pennsylvania

Scammed by car dealership

My son brought a car. He traded in his jeep and gave them $680. Two weeks later, they contact him and say he needs a cosigner because they can't find a bank that will finance. If he doesn't produce one, they want their car back and they won't refund his money or jeep. What are his rights? We want to fight.

It depends on what you signed (or agreed verbally). If the entire agreement was for your son to trade in the jeap and pay them $680, then his finance doesn't seem to be part of anything, and the dealer can't suddenly make it an issue.

If, instead, the $680 was merely a downpayment and he does have a continuing obligation, and the contract you signed gives the dealer the right to demand a cosigner if they can't find their own financing, then it is possible they could demand the cosigner or call the deal off.

Unless you signed a particularly onerous agreement (which could be so bad it'd be illegal [also known as "unconscionable"]), they certainly can't cancel the sale and also refuse to refund him anything.

Make the dealer show you exactly where your son agreed to let them demand a cosigner after the deal was signed, and make them show you where your son agreed to forfeit his trade-in and payment if he couldn't find one. If you don't see it in there, don't take their word for it. They can't just make this stuff up afterwards.
