Suing My States Department of Transportation

In 1993 I discovered Someone was using my drivers license.

This person ran up 5 tickets under my license. He was eventually caught and received probation. He obtained my license very easily. His picture ended up on my license.

The department obviously failed to protect my identity.Which led me to years of headaches.

I ended up getting a new drivers license number.

This year I blew a stop sign and received a ticket. Now old unpaid tickets from the fraud transfered to my license.

The local court realized I am not guilty, but the state still trying to take my license for not paying those tickets. I would really like to sue the state for being negligent in protecting my identity. All they had to do was ask this person for picture ID when they took his photo on my license. Would I have a case against the state for being negligent in protecting my identity?

The State has immunity unless a specific exception can be found in your case. I do not believe there is an exception. However, it has to be research. You certainly have a right to appeal an revocaton of a license, but it must be done within thirty days of licence revocation notice. I suggest you consult with legal counsel. Gerald Hershenson Esq.
