Legal Question in Civil Litigation in Pennsylvania

tennat/landlord dispute

my former landlord has threatened to sue me for $1500 for damage he says i caused. The rental property i lived in is in Pennsylvania, I now live in California. If he files a small claims action, what state must it be in? If the keys were transferred to the next tennant prior to my moveout inspection (12 day overlap), am I still responsible.

The case would have to be heard in Pennsylvania. If he begins proceedings there and you do not take part, he may be able to obtain a default judgment against you and enforce it in California. As a California attorney, I don't know what rules govern such proceedings in Pennsylvania.

You will also need a Pennsylvania lawyer to answer the second part of your question, about the effect of the early transfer of keys.

The proper venue for the lawsuit would be in the state which the property is located. If you are sued you must file an answer immediately. You should contact the court in the county the lawsuit is filed in if you are served so you can get the proper forms to answer. Good luck.
