Legal Question in Civil Litigation in Pennsylvania

Wrong product

Hello, I appriciate the help. My issue is that I had new windows installed all through my house. By chance I found out that the wrong windows where installed. They seemed to have installed the lowest grade of window that they sold. I had ordered the mid range priced ones. I informed them and they are willing to order the right ones and replace them all. However I asked them about being compensated for the day of lost work. There responce was that they are willing to make things right by replacing the windows with no compinsation. They also offered the difference in price if I wanted to keep the windows I have. This is a Big name Company all over the east coast. I would like to know what options I might have to come back with ... Such as ask them for my money back and the old windows ??? (Of course they are not going to have the old windows). But I do feel I should be compensated for the lost of a days pay. Or a vacation day that I would need to take for a mistake that had nothing to do with me ... Please help

I understand and symphathize with your desire to be paid for a day at work; but it is not worth litigating over. It is obviously a reputable company if they are willing to rectify their error. I would accept the correction and move on.

Mr. Eckell is exactly right. You are doing well if the company fixes everything and you just lose one day of work. The company is going to lose money on this project after they put in the correct windows and write off the time and materials for the wrong ones. Too bad for them; it was their mistake. It is frustrating for you when you did nothing wrong, but you will lose a day of work anyway if you take them to court, and you will be living with the wrong windows in the meantime.
