Legal Question in Immigration Law in Pennsylvania
Advanced Parole
I am a Non-immigrant living in USA for last 11 years I recently got my I485 approved, my wife who has been living with me in USA for last 7 years is also a beneficiary of my application and has been working for Hospital as a Medical Technologist and has a small business for last 2 years with a 130000$ investment, which employees 2 American citizens in a depressed area.
She had to travel (23rd June 2007) in an emergency to India to visit my ailing and medically sick father with my 5 year old son who is an American citizen. Unfortunately she is traveling without her Advance Parole, which was applied in 1st week of May 2007 and her pervious advance Parole got expired on July 1st week 2007. We had applied together, but my EAD/AP got approved in May hers is still pending at TSC. Meanwhile while she is gone my I485 got approved and we have been getting finger printing letters for her.
Due to the delay in getting her parole she is stuck overseas (Pakistan) with my son, who is not feeling medically well and the situation of that country is not good. I need help in bringing my family back to US. What are my options??

Re: Advanced Parole
You asked about a non-citizen stuck overseas without proper paperwork to return to the U.S.
You need to get in touch with an attorney that specializes in immigration law. S/he can act as an intermediary to get a special dispensation to get your wife and son back to the U.S. promptly.
Very likely your wife will need to go to the nearest major consulate and get a temporary emergency visa based on the advance parole. She can have her fingerprints done in an authorized place in-country.
Get in touch with an attorney and they should be able to sort the matter out quickly.

Roger
