Legal Question in Immigration Law in Pennsylvania

expired K-1 visa

My friend just found out that his

fiancee he planned on marrying in

August, is here on an expired K-1

visa. After moving in with the her K

-1 petitioner she feared for her

safety and fled to live with a relative.

She has been in the US ever since.

What kind of options does he have -

if any?

Re: expired K-1 visa

You asked about a person here on an expired K-1 visa.

It's not an uncommon problem. But you need to get to work on fixing it. Since she arrived legally she is in a much better position than someone who arrived illegally. Moreover, if the cause for flight from the previous affiance can be demonstrated there is much more likelihood of reasonable treatment.

Get he and she to an immigration attorney that is a member of the immigration bar (AILA).

Regards,

Roger
