Legal Question in Immigration Law in Pennsylvania

Hi,

I Have h4 visa valid till sep 2013, i left to India in feb 2012, my employer applied for H1 in april 2012, present its under intial review....Now i want to leave to US in june 1st week ..can I go on h4 ??? as there is COS ..will it affect my H1 approval?? what i need to do now?? as i want to avoid stamping

If you travel while H1B petition is pending with the USCIS, you will not be granted change of status.

You can enter the U.S. on H4 visa stamp after traveling abroad, but then you will no longer be in H1B status and therefore cannot be employed.
