Incorrect Oil Delivery

An oil company that I do not use, have used, or have a contract with delivered home heating oil to my house in errror. I did not ask for the oil, give them permission to come on to my property. I called to inform them that their customer did not receive thier oil. Now they want me to pay for the oil. Do I need to pay for thier mistake? Can I refuse to pay for the oil? I currently pay a monthly bill for my oil. A set monthly price over 12 months. I can't afford another oil bill. What are my options?

You asked about paying for an oil delivery that was mistakenly delivered to the wrong address.

It's a very interesting issue. If you are certain that the oil was delivered then you will end up paying something for the oil. Oil is a commodity and the law does not usually let us keep something to which we are not entitled. It's called unjust enrichment. But the law also does not require that we accept every scam that comes along.

The best bet is to come to a resolution with either your own oil company. Either they pay the other company back in oil (and charge you for the amount of oil you recieved). Or better yet get the company that delivered in error to accept the same rate that you had guaranteed.
