Obtaining a Lawful Immigrant Status

My mother just became a naturalized US citizen, Im 29 yrs old and unmarried - entered US via a lawful student visa (expired) - Had DWI record expunged - What is the best course of action ?

Your mom will be able to file for you, but based on the information you provided, you will not be eligible to receive your green card while you are in the US. However, you may face bars (i.e., be ineligible to return to the US for 3 years or 10 years depending on your F-1, if you leave the US). I recommend that you discuss your options with an attorney.

Please also note that right now the wait time if your mom files for you is approximately 6 years.

Your mother can file for you, however, 2 issues need to be addressed - your unlawful presense in USA and DWI record.

You should contact an attorney to properly process this matter.
