Legal Question in Immigration Law in Pennsylvania
My spouse of 5 years is a green card holder, myself and our 2 children are Canadian we are currently in the USA would it be better for him to file for us with us staying here or better if we go back to Canada? Also how long would be the process? We also have children together born in the USA. Thanks for your guidance and your help.

If you are out of status, then departing the U.S. will trigger a 3/10 year bar to admissibility. Your spouse should file for naturalization asap. Then, he can petition & your children you as soon as he becomes a U.S. citizen.
