Starting a Subsidiary of Indian company in USA while on H1B

I partially own a software development center in India. Right now i am in the USA on an H1b Visa with another company.

Is there a way to start a subsidiary of my Indian company in USA and do the necessary paper works while i am in the USA on H1B.

Are there any other alternative options for me like starting a new company?

One of the options is an L-1 visa (Relocation visa). One of the requirements is that you worked at the company as a manager/executive for one year during the last three years. Assuming your H-1 is new, and you did work in India at the Company, this is a possibility.

An investor visa, E-2, is not available to nationals of India.

If we are talking of EB-5 visa (Investor Green Card visa), then you need to invest $1M and create 10 jobs, unless you establish the business in a rural/unemployment area, and then you may invest only $500,000.

Best Regards and Good Luck!

You could try to get an investor visa if you plan on investing a significant amount of money in the US. How long did you own this company? Feel free to contact me via email or phone. 610-565-5280.
