Legal Question in Immigration Law in Pennsylvania

next step???

One of my best friend had an initial interview for marriage based green card in August. They didn't do too well at the interview, according to her, they even got separated and didn't have the same answers at that time at all. They were told nothing but that they'll be informed. Welll, 3 and 1/2 months went by and they got nothing. She is afraid that she could get deported. Would that be possible? Or could immi be that slow? Is there anything she should/could do? Her husband told her (he is citizen) that they can appael but he has no clue either how and what to do.... Any suggestion?

Your friend should relax a little. The interviewers are looking for fraudulent marriages. This is more commonly inferred from things other than the answers given by people being truthful. Essentially, if the couple had answered all questions correctly the interviewer would have had more questions such as whether the answers had been rehearsed. The key isn't getting the answers correct, but rather answering truthfully.

Your friends should hire an attorney. In consultation with an attorney they can decide whether they need to get aggressive or not. Probably not, as one interview will not form a basis for exclusion unless there is obvious fraud.

As long as the marriage is legitimate there really should be nothing to worry about. In fact, other than gross fraud, a situation that would result in a revocation of a visa would result in a hearing rather than any notice of deportation (and the result would be a revocation of the visa rather than a deportation order).
