Accident in her father's car

About 1-1/2 years ago my wife was rear-ended while in a car in her father's name. The driver of the other car was cited for driving at an unsafe speed. My wife received a broken eye socket and a ruptured disk in her neck. Since the accident, she has had surgery to fuse her vertibre together to prevent the disk from causing permanent nerve damage. The surgery has left an unightly scar on the front of her neck, and has not been able to perform any duties for the last 4 weeks. She was not listed as a driver in her father's car, but was covered for the accident. We had a car in our name, but there was no insurance on it. I had a company car, and she used her father's. We are told that we would fall under limited tort for that reason, even though her father's coverage had full tort. What can be done to collect punative damages?

First, you are running out of time. D o you have a lawyer. Second, even if you are limited tort, I believe rhe injuries will overcome the limitation on the right to sue. I urge you to get appropriate counsel asap.
