accident with no insurance

I was involved in a accident last june . I was driving straight a ahead in middle of 3 lane expess way when some mototcycles cam e flying by going 150 mph, the 3 rd one hit my front left tire and crashed, At the time I had no car or insurance of my own,but it was my friends car who has full coverage because he has 2 other leased cars and has highest amount of coverage no tort, 150 to 300 i think, the guy who hit me was driving a stolen bike and had no insurance. He died instantly . Police said it in no way was my fault but now I have purchased my own car and it says I have a at fault accident, because of this, I even got a letter form the ins sayin it was not my fault, how can I get them to remove this of my ins points? also can I get pain and suffering , I was injured in this accident, and I am self employed, is that a problem when it come to setleing?

Your inquiry raises 2 questions. First, if your insurance comapany is considering this to be a chargeable (your fault) accident, and you have a letter from the insurance comapany that insured the car you were in saying it was not your fault, you should contact the Pennsylvania Insurance Commisioner and file a complaint against your present insurance company. They should investigate your complaint and tellyou the results. If that fails, you should see a lawyer about bringing a case against your insurance company.

Second, if you were actually injured in the accident, you should be able to recover uninsured motorist benefits from the vehicle you were driving, so long as you had the owner's permission and he had uninsured motorist coverage.

The first thing you should do is to consult with an attorney in your area who handles personal injury cases. Most lawyers charge no fee for an initial consultation in a situation of this type.

1. Contact the Pa. Insurance Dept to complain that your insurance company is performing inproper underwriting practices by re-rating you for an accident not your fault;

2. Contact an experienced personal injury attorney to investigate a possible uninsured motoist claim for your injuries. My office does this work. I would be glad to speak with you without charge.
