Legal Question in Insurance Law in Pennsylvania

Auto insurance

I was in an accident going south on a road when a teenage girl did not stop at the alley &shot across the street I was on..........I slammed on my brakes and hit her back end. The police wrote an accident stating that she did not yield to oncoming traffic. It seems that she might have told her parents that someone hit her since her back end of the car was hit and this is what they told the insurance. We both coincidentally have the same insurance carrier. I faxed the accident report and they are still looking over the details claiming that it is called ''compatible negotioation'' saying that we are both at fault and will need to pay the deductible. How fair is that if the accident report even claims that she did not yield at the intersection?

This is a typical tactic of insurance companies. They will use any excuse not to pay. The only thing to do is be aggressive in maintaining your position that the other driver failed to yield the right of way, & that you had the right of way. The points of impact are irrelevant. It may be that negotiation will fail, & your only redress will be in court. Good luck!!
