Legal Question in Insurance Law in Pennsylvania

Car stolen off repair lot

My car was stolen off a dealer lot when it was in for repairs. The lot was gated and guarded, but they still managed to hot wire my car and drive it into a river after they were done. What legal responsibility does the dealer have to replace my car? It is totaled and unable to drive. The dealer told me to call my insurance company to handle this, but that seems unfair, because it was stolen off their lot. What do I do from here?

Re: Car stolen off repair lot

The dealer is responsible. However, you can go through your insurance company. Keep in mind that you will initally be responsible for any deductible. If your insurance co. pays the claim, it is likely it will seek to be reimbursed from the dealer, or the delear's insurance company. When that occurs your insurance co. will obtain reimbursement of your deductible. However, "there ain't no guarantees."
