Child runs into car while riding bike
My girlfriends child was riding his bike when another child rode in front of him causing our boy to crash into a parked car. The owner of the car is now threatening to sue our 14 year boy for the damage to the car. He won't turn it into his insurance company. Thank You.

If you have homeowner's insurance, the best thing to do is notify the insurer of the claim, unless it's a very small amount, & you want to handle this yourself. Let your ins co handle it. If you do not have homeowner's ins, there are defenses to the claim. You will need to consult with an attorney if a law suit is filed. Also, since your son presumably doesn't have any money, there's no way the car owner can collect.

If he does sue the defense the child has is "Sudden Emergency". The actions of the other child were unanticipated and caused the child to take a reasonable course of conduct (Avoiding the other bike Causing property damage rather than personal injury). If the claim is less than $500 you might be better off settling before trial. If more, an attroney can probably be had for that amount to defend the case at the district Justice level.
