Coordination of Benefits

Under Pennsylvania law, is a person injured in an auto accident allowed to recover both PIP (no-fault) benefits for lost wages as well as short-term disability benefits for lost wages? In the absence of contract language allowing reimbursement, can the disability insurer recover or be reimbursed for the benefits it paid?

Generally, a disability policy provides a fixed amount of benefits when a person is disabled and there isn't an offset for PIP recovery. Some disability policies will coordinate with Social Security or other types of disability benefits, but it basically depends on the language of the policy. Normally a disability insurer has NO right of reimbursement from any other source. But as you recognize, it all depends on the actual policy language.
