who is at fault

I was driving my car and hit a mans van while he was backing out of his driveway. I was going the speed-limit, maybe even under... who is at fault for this accident and what should i do with insurance. My car was totalled and his has only a dent in the rim and side pannel.

Submit the claim to your insurance company. It seens from what you say the other driver is 80-100% liable for the accident. If the insurance company gives you trouble contact an attorney. I offer free consultations.
