Legal Question in Insurance Law in Pennsylvania

Help me please!

I have an important question. I was recently involved in an automobile accident in Dec of 2002. At the sceen of the accident I was considered the person at fault in a 3 car accident. At the current time I did not have insurance and now I am being sued by the victims insurance company for about 5,000. I am a college student @ Montgomery County Community College and as like most students, finicially I am not well off...basically I am broke! I was wondering what exactly could they do? I am a college student with no money and nothing in my name besides my car, could they put a lean on my car or other items? Also, the victim I hit is sueing me for front and back damages to her car...I believe she is at fault for the front damages done to her car...she hit the person in front of her first then I hit her. Therefore, I can not be held responsible for all of her damages. I want to contersue her based on this concept. Please email me back for any information you can give me or any questions you might have. Thank you so much

Re: Help me please!

You do not say what the insurance company is suing you for, but it sounds like subrogation (claiming the money it spent on repairing its insured's vehicle, medical bills, and/or lost wages). You may be able to work out a payment agreement, so much per month.

If the other vehicle hit the one in front of her before you made contact, this would be an important defense for you to raise to minimize the damages for which you are responsible. (Although if the insurance company is claiming for the property damage, the other driver would not claim it because she did not pay for it.) You would not "countersue," however, but rather raise the other driver's negligence and resulting front-end damage as a defense.

This is general information for discussion purposes. Please feel free to contact me if you want to form an attorney-client relationship.
