Legal Question in Insurance Law in Pennsylvania

I was injured and I want money.

I was in an auto accident about 3 weeks ago and suffered from torn ligiments and a sprain in the neck and back problems which i am being treated for now. I was todl by the opposing insurance company that i can not recieve pain and suffering because we only have limited-tort coverage i was wondering if there was any way i can recieve any money besides what i recieve from my loss in income?? thank you ,mike

Mike- it is unfortunate you selected "limited tort." Because of that selection your insurance compnay gave you a very small reduction in your insurance costs. In exchange you waived your right to sue a driver who injured you for pain & suffering damages unless your injuries are so severe as to be considered "serious injuries." Most sprain and strain injuries will not qualify. I suggest you change your auto policy to "full tort", and make sure your policy has "uninsured motorist" and "underinsured motorist" coverage. It will not help you for this claim, but will give you protection in the event of a future injury.
