Well, you certainly have the option of filing suit if you do not get what you feel you deserve from the insurance company. Typically, insurance companies will not make significant settlement offers early on and will try to hold onto their money as long as possible. You state that the insurance company for the other driver has assumed 100% liability. I am curious as to how that was communicated to you. I am also curious why an attorney would not want to take on your case when it appears that liability is not an issue and, with $20,000 in medical bills, the injuries may be signifcant.

You need to engage an attorney. You have a slightly increased problem where you are physically located in a state different than where the accident happened. Insurance companies want to prevent making any payments until the last possible moment and will do everything they can to minimize the amount they have to pay. An aggressive representative can get you the absolute maximum you are entitled to.

Attorneys are prohibitted by law from talking with an individual who is represented in a matter by another attorney. If you would like to speak with other attorneys you must make certain that you have severed a relationship with any attorney. Then contact attorneys until you are comfortable that one will give your case the attention it deserves.

You can choose to speak with an attorney either in the state where you live or where the accident occurred. An attorney licensed where you live will have some trepidation because he is unfamiliar with the law in the state where the accident occurred. A lawyer in the state where the accident occurred will have some concerns for the converse reasons. As you can guess, each state has its own laws and precedents that govern your potential recovery.

No matter, remember two things, the first is that you and your girlfreind should be concerned first about getting better and getting all the treatment that you require. The other is that you must NEVER speak with anyone but your attorney about the accident and your care.
