Legal Question in Insurance Law in Pennsylvania
Life insurance - error and omission liability
I was informed after my father's death this July, that I was a
co-beneficiary of a life insurance policy. I was not even aware of this
policy, but still happy that $34,000 would be split
50/50 with my stepmother. It was confirmed over and over that I was to
expect money. My step-mother retained an attorney, and next thing I know
all the $34,000 is being awarded to her. The insurance co. issued an
apology for their mistake, but according to them I am a secondary
beneficiary and not primary. Even after seeing the section under
beneficiary, I am not so sure they are correct, but regardless, can they
make a $17,000 mistake with no repercussions? I even signed papers from
them to collect the money. Because I have written a letter of complain
to their manager, it is being reviewed. I never had an argument with my
father during his life, and because of their mistake, I cannot help
feeling angry at my dad for not being clearer with his wishes..

Re: Life insurance - error and omission liability
Your message does not say what the life insurance contract says or who assured you that you were a co-beneficiary. It sounds as if you need to have an attorney experienced with insurance companies review the insurance contract and beneficiary designation with your interests in mind.
