Legal Question in Insurance Law in Pennsylvania

misrepresentation on claim

My wife recently died after a serious illness. one year ago we took out a life insurance policy. My wife was feeling well at the time, not going to the doctor for many years and not taking medication. I think my insurance company is about to reject my claim on the misrepresentation clause of the contract claiming that she was diagnosed with a illness at the time and did not disclose it.

Do I have any legal recourse and, is it worth fighting?

Re: misrepresentation on claim

As long as the facts stated on the Application were accurate, then there is no legitimate reason for the insurance company to deny coverage and payment. A determination of whether or not it is worhtwhile to fight any denial of payment would require a more in depth analysis. Please contact me, or another experienced attorney, if you need more assistance.
