Legal Question in Insurance Law in Pennsylvania
Post tramactic stress disorder after a car accident
I was hit on December 29th 2000, when someone ran a red light. I have not worked since January 21st 2001, because i can not get in a car. I had limited tort, and was told I could not sue. My insurance company at work paid for five weeks, of lost wages and stopped. The guy that hit me insurance has not paid any lost wages.I have not been seen by a MD, because I can not get to one. I found a psycolgist who is treating me at home. I don't know what to do, my life has been turned around ,and know one wants to help. Please tell me I have some recourse.

Re: Post tramactic stress disorder after a car accident
Limited tort applies to your ability to recover "non-economic" damages, commonly known as "pain & suffering" damages. Since you selected limited tort you cannot recover non-economic money damages unless your injuries are considered to be "serious injuries" under the Law. I do not know if your injuries will be considered serious. I would have to discuss that issue with you in more detail. If you are physically hurt it is very important that you obtain medical treatment, no matter how difficult your transportation problem. Some hospitals provide home physical therapists. Even if you have limited tort, and even if your injuries are not considered serious, you can still recover your economic loss, for example the lost wages not paid by your insurance company, or any medical bills not paid by insurance. I hope the above answers some of your questions. Please call my office, 610-668-6424, if you would like to discuss this in further detail.
